1) Mailing lists must be double opt in lists.
2) Messages must have clear removal instructions and valid headers.
3) Removal requests must be completed with in 24 hours.
4) Messages must include details on how the user subscribed. These details must be provided to justice-hosting on our request.
5) Excessive complaints may result in account termination.
6) justice-hosting reserves the right to charge $100 fee for IPs which are blacklisted/identified as spamming sites due to failing to adhere to justice-hosting policies.

We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion.

We  reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee of $30.00. This cost of the clean up fee is left entirely to the discretion of justice hosting. All rights reserved.

Support Boundaries

Justice Hosting, provides 24 x 7 technical support to our subscribers, All servers housed at our facility are managed, justice hosting Only ensures that the server is online and is remotely accessible. justice hosting does not provide technical support for YOUR customers. If you can email, we encourage you use our support ticket system for assistance.

Disclaimer

We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.

4.) All justice-hosting Customer Billing Information [Top]

The following Terms of Use constitute justice-hosting's Billing Policy and apply to ALL justice-hosting customers:

Payments

All charges are shown in US Dollars. Payments are to be made in US dollars. justice-hosting accepts the following types of payment:

• Check or Money Order

• Credit Card (VISA, MasterCard, American Express, Discover)

• 2Checkout

• Google Checkout

• PayPal

All payments are due on the Account Statement Date. The Account Statement Date is the monthly anniversary of the date the account was activated. If you provide justice-hosting your credit card information, you authorize justice-hosting to automatically charge your credit or debit card for charges that apply to your account. Recurring charges will be posted to your credit card until such time that you cancel your account in accordance with justice-hosting's Billing Policy in the TOS. You are responsible for directly updating, or notifying justice-hosting, of any changes to your credit card (including, but not limited to card number, expiration date, billing address, or card status). Clients may not make anymore payment arrangements after breaking two arrangements.

Customers not paying by credit card agree to make payment of their balance due within ten (1) days of the Account Statement Date.

Accounts that are (1-5) days past due will be automatically suspended and be assessed a late fee.

Billing Cycles (Terms)

justice-hosting offers three Billing Cycles (terms) for hosting charges: Monthly, Quarterly (3 months), Semiannually (6 months) and Yearly (12 months). The Billing Cycle begins on the Plan Activation Date. Resellers are limited to the monthly Billing Cycle for all of their charges. Non-credit card payment methods are limited to Annual or Quarterly Billing Cycles.

You may elect to change your Billing Cycle at any time; however, the new Billing Cycle will only take effect at the time of the next plan renewal.

All additional features added to an account are charged monthly. Additional items are non-refundable.

Account Renewals

In order to insure uninterrupted service to your website, all plans will automatically renew at the end of the plan's Billing Cycle. Plan renewal charges are based on the prevailing rate on the date of renewal according to the service selected. Plans are renewed for the same billing cycle. If you wish to cancel your plan before plan renewal, please refer to the Cancellation section below.

Non-Payment

All payments are due in full on the monthly anniversary date. Failure to remit payment for services on the monthly anniversary date is a violation of the TOS. Failure to remit payment for (3) consecutive days, including the anniversary date, shall result in a suspension of public access to Customer services. Customer shall maintain access to data and services through the service network. Failure to remit payment for services within (15) consecutive days, including the anniversary date, shall result in termination of access to the service network and all services shall be reclaimed. A late fee of $30 will be incurred for failure to remit payment for services on or before the monthly anniversary date. Please refer to the late fees and reactivation fees section of this document for your exact fees for reactivation of your account. All Customer data remaining after seven (60) days of non-payment will be destroyed for security and privacy reasons. All late fees must be paid in full before services can be restored to the client.

Statements

justice-hosting does not mail paper invoices or statements. Statements can be viewed and printed through Web host Manager Auto Pilot. Customers may elect to receive their monthly account billing statement via email. This option may be selected in Web host Manager Auto Pilot.

Billing Date

All justice-hosting Customers billing date is approximately 1 days before your original purchasing date (Also known as our 3 day grace period). Your account may fall in to suspension if payment is on received in the 1 day early grace period. If account is past the the 3 day grace period late fees & possible reactivate fees will be assessed.

Credits

In order to receive credit the client must submit a trouble ticket with in seven (7) days of the outage. The date and approximate time must be included in the trouble ticket. If justice-hosting confirms the outage a credit will be applied with in seven (7) business days.

Fees

* Returned (NSF) Checks
justice-hosting charges a $30.00 fee for returned (NSF) checks. Customers that issue an NSF check will be required to submit future payments with a certified check or money order.

* Credit Card Chargeback's
A $30.00 chargeback fee will be assessed for each credit card chargeback received by justice-hosting. Credit cards that are declined for any reason are subject to a $30.00 declination fee.

*Dedicated Servers Only
Service will be interrupted on accounts that reach 1-3 days past due. Credit cards that are declined for any reason or Paypal payments that are either rejected or not made when Services are invoiced are subject to an additional processing fee of $30.00.  Service will be immediately interrupted on any account that is unpaid. Service interrupted for non-payment is subject to a $30 suspension charge. Accounts not paid by the due date are subject to a $5 late fee that accrues daily until paid in full. Accounts that are not collectable by justice hosting may be turned over to an outside collection agency for collection. If you account is turned over for collection, you agree to pay the company an additional “Collection“ fee of not less than $50 nor more than $150. If you desire to cancel the account, please follow the correct procedure to do this at

* Bank Wire Payments
justice-hosting does NOT charge fees for accepting payment via bank wire, however, international wire transfers may be assessed a $30.00USD processing fee by an intermediary bank in Alexandria. In addition, your issuing bank may also charge a fee for sending the wire. Please add these fees to the amount that you are sending to justice-hosting or the amount credited to your account will be less than your intended payment.

* Reactivation
Reactivation is a charge that is automatically applied to the bill when customers account goes past due and has been suspended. Customers that wish to reactivate a suspended/closed account will be assessed a $30 reactivation fee.

*Shoutcast Radio Bit rate Fee
Any shoutcast radio that goes over the limit of their allotted bit rate more than 1 times the radio will auto suspend from 1-30 days and there will be a $30 reactivation fee. It is the users responsibility to keep their bit rate AT or BELOW their specified limit. We reserve the right to keep any and all auto suspended accounts suspended without reason.

*Late Fee
Please note that if your payment is overdue then your account(s) may be suspended after 1-5 day(s) overdue. justice-hosting has the right to charge Late Fees and Reactivation fees upon your account falling into the 1-5 day(s) grace period. Accounts will be removed from our servers after 30 days without notice if payment is not received. All fees are non-refundable. Late fees are, but not limited to $30 if payment is not receive on the due date (We reserve the right to suspend accounts before and during the 5 day grace period). In addition we may also assess you $5.00 per day that you continue not to cooperate and make arrangements.

* Hosting Plan Changes
Customers electing to change to a lower priced hosting plan on the same platform will be charged a $19.95 downgrade fee. There is no upgrade fee for upgrading to a higher priced plan, however, you will be charged any difference between the setup fee applicable to your new and former plans.

* Platform Change
Customers that elect to change plans to a different operating system platform will be charged a $30.00 platform change fee.

* Account Splits and Mergers
justice-hosting encourages customers to merge hosting plans contained in two or more accounts into one account. There is no fee for this service. Customers may also request that justice-hosting separate one or more plans contained under one account into separate accounts. The fee for this service is $19.95 for each new account created and is charged to the new account. Please direct all requests for these services to: support@justice-hosting.com.

30-Day Money Back Guarantee

Each of justice-hosting's shared hosting plans carries a 30-day unconditional money back guarantee. If you are not completely satisfied with our services or support within the first 30 days, you will be given a full refund of the fees paid in advance (excluding setup fees) upon plan cancellation. The following services do not qualify for the 30 Day Money Back Guarantee: additional items and services; domain name registration; dedicated servers; items and services ordered through the reseller program; domain parking plus; overage fees and shout-cast radios. We reserve the right to refund a prorated amount or no refund at all.

The 30 day money back guarantee does not apply and will not be issued if more than 20% of allocated data transfer or disk space has already been used on the web hosting account. If you have us modify your account from it's original version, whether this be an upgrade or downgrade of any kind then you'll not be eligible for a full refund. The money back guarantee does not apply if the account has breached these terms and conditions prior to cancellation. We our not responsible for issues with your own equipment or service that prevent you from being able to use our service correctly. In the event a problem arises with our service not working correctly for you, we'll do everything in our power to try to resolve the issue and require that you work with us every step of the way. If you work with us in getting the issue resolved then a refund, either full or partial, may be issued at our own discretion. If you refuse to work with us at any point then any rights to a refund will become void under this agreement.

Customers using special offers (coupons) at time of purchase are not entitled to the Money Back Guarantee and whether or not they are able of receiving a refund for any reason is our choice. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

Billing/Price Changes

justice-hosting's policies and prices are subject to change without notice. Any price changes become effective in the next billing cycle.
Special Pricing Ends at 12:00am OF The Date Listed On The Specials Page In other words the specials are no good if the actual day matches "Today's Date".
Specials We Reserve The Right To Cancel Our Specials At Any Time. Most Specials Will Not Last More Than 1 Week. If You're On a Special Package And You Change Packages You Will NOT Be Able To Get On That Package Again.

We DO NOT tolerate customers paying with fraudulent information or stole credit or debit cards and accounts purchased with such with be terminated at once. You agree to supply appropriate payment for the services received from us, in advance of the time period during which such services are provided. You agree that until and unless you notify justice hosting of your desire to cancel any or all services received, those services will be billed on a recurring basis. If you pay with a credit or debit card or any other payment option that is not rightfully your property and ownership you hereby agree that you will be submitted as a con artist and will be taken to highest level of pay pal necessary to get our funds.

Accounts that are not collectable by justice-hosting will be turned over to an outside agency for collection. If your account is turned over for collection, you agree to pay the company a “Processing and Collection” Fee of not less than Fifty($50.00) nor more than One Hundred, Fifty($150.00).

We reserve the right to change the monthly payment amount and any other charges at anytime.

5.) Backups and Data Loss [Top]

6a.) Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. To order backups please submit a email to support@justice-hosting.com with your Name, Email, Paypal Address, Reseller Username and package your on and we will follow up with you as soon as possible.
6b.) In order for backups to be 100% effective Weekly emails need to be send to support@justice-hosting.com listing all of that resellers account that need to be backed up and one of our administrators will add them to the backup list. Backups must be restored by an administrator there's no other way to allow resellers to do this themselves.

6.) Cancellation [Top]

We reserve the right to cancel the account at any time.

Hosting plans will automatically renew until a plan is cancelled. In order to cancel service, you must contact justice-hosting's Customer Service Team.

Cancellation requests must be received by justice-hosting a minimum of (10) days prior to the end of your Billing Cycle for dedicated server plans and a minimum of (5) days prior to the end of your Billing Cycle for all other plans. Cancellations submitted later than this time may result in automatic renewal of your hosting plan. Cancellations become effective on the day processed by justice-hosting. justice-hosting is unable to cancel your account effective for a future date. justice-hosting will confirm the cancellation request when it is processed. If you do not receive a confirmation, please contact us.

justice-hosting does not monitor, and will not automatically cancel, plans for problems related to domain name transfers, non-usage, Internic, your ISP, or any other secondary issues not directly related to justice-hosting's services. Cancellation of services does not relieve the customer from paying any outstanding balance owed on the account. justice-hosting Corporation reserves the right to cancel any account, at any time, without notice, for any reason justice-hosting Corporation considers appropriate.

You must notify us in writing (email) that you wish to cancel your account. Your account will then be canceled 5 days after you send the email stating your cancellation request. If you do not inform us at least 5 days prior to the renewal date, your account will be renewed at the current fee. You will still have to pay for the full period if you cancel your account in the middle of a billing period. Cancellation does not clear you of any outstanding amounts; any balance due at the time of cancellation must be paid in full. You must ensure you have a full back-up of your data before canceling your account as we do not save your data upon cancellation and will not be able to restore that data.

7.) Indemnification [Top]

Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Justice Hosting's server.
justice hosting assumes no liability of the Client for failure to follow this Agreement and any results caused by the acts, omissions or negligence of the Client, sub-contractor or an agent of Client or an employee of any one to them, including, but not limited to, claims of third parties arising out of or resulting from or in connection with the Client's products, messages, programs, caller contracts, promotions, advertising, infringement or any claim for libel or slander or for violation of copyright, trademark or other intellectual property rights.

8.) justice-hosting Dedicated Server Customer Restrictions [Top]

The following Terms of Use apply only to justice-hosting's Dedicated Server customers, and supplement the terms in sections below that apply to all justice-hosting customers:

Customer Security Responsibilities

The customer is solely responsible for any breaches of security affecting servers under customer control. If a customer's server is involved in an attack on another server or system, it will be shut down and an immediate investigation will be launched to determine the cause/source of the attack. In such event, the customer is responsible for the cost to rectify any damage done to the customer's server and any other requirement affected by the security breach.

IRC Servers

justice-hosting allows Dedicated Server customers the use of IRC inside the justice-hosting network as long as the use of IRC on a justice-hosting server does not violate any of the other terms of these TOS. As a policy, justice-hosting will not provide vanity IRC reverse DNS records. To enforce this policy justice-hosting does not turn the reverse address of IPs over to the customer. Authority over this information remains with justice-hosting.

Billing for Network Resources

The customer understands that the customer is responsible for paying for any network resources that are used to connect the customer's Dedicated server to the Internet. The customer may request that the customer's server be disconnected from the Internet, but the customer will still be responsible for paying for any network resources used up to the point of suspension or cancellation.

Purchasing

Dedicated Servers - If we out are out of a certain server your order may be delayed up to 72 hours however if we have not received more parts for your server, your order will be refunded.

9.) Domain Agreement [Top]

You acknowledge that You have read understand and agree to be bound by all the terms and conditions of this Agreement, along with any new, different or additional terms, conditions or policies which justice hosting may establish from time to time. We provide you with your own login to your domain to modify DNS, Password, Renewals, and Contact information. In the even that you no longer want us to provide you with hosting and you have paid for your domain name we will continue to provide you access to domain(s). These include, but are not limited to, hosting bill is current and domain payment has been processed. Domain Transfers In consideration for the domain transfer ("service") purchased by You and provided to You by justice hosting. justice hosting reserves the right to charge a reasonable service fee for transferring domains from 1 domain registrar to another registrar.

When you purchase a domain name from justice-hosting, your one year contract takes effect the same day. If you choose to terminate your account with our service before the one year ends; as a penalty we will hold the domain name in our control.
PAID DOMAINS - If you purchase a domain name from us the name belongs to us for an agreed 12 month period and until the 12 month period has passed you may not claim the domain name from us in the event you switch hosting. Once ownership of the domain name has been turned over to you it must be transferred to your own account at your registrar and you take full responsibility for it including all prices and fees at that time.

Your domain name can be redeemed by doing all the following:
·Payments all on time (Due Date)
·Good Standards
·You comply with a 30 day notice that your terminating your account
·$15 Transfer Fee

10.) Referrals & Affiliate Programs [Top]

Reseller  Referrals

Resellers when then refer potential clients to our website for reseller accounts and they make a purchase and tell us who referred them that reseller will receive Half Off your next billing cycle (Only for 25$ Packages and Up).

Shared Hosting Referrals

When you get justice hosting a new hosting customer, you get in return half off of your hosting on your next billing period. If you get justice hosting two new customers in one month your next billing period is free of charge ONLY for packages above $15 and up.

11.) Refusal of Service [Top]

We reserve the right to refuse or cancel service at our sole discretion. If you breach any of the above terms and conditions we reserve the right to deactivate your account immediately.

We appreciate your help in keeping our networks a safe and reliable place to host and we'll take note of all reports we receive, whether or not action is taken is at our own discretion.

We reserve the right to revise & change our policies at any time without notice to our clients. However if any major policy changes are made clients are notified in advance.
